Why Italy?

A company foothold, not a shop: A foreign company can open an Italian representative office (ufficio di rappresentanza) to study the market, gather information, and promote the foreign company. It is not a branch that sells or produces in Italy.

Residence for the appointed representative: The person named to run that office can then pursue an Italian national visa and permesso di soggiorno tied to that role. This is not citizenship and not an investor visa.

No Italian trading company required: You do not incorporate an S.r.l. or S.p.A. to open a pure representative office. The foreign company stays the principal. The office needs a real Italian address and a named representative on the Companies Register.

EU access while the permit is valid: A permesso di soggiorno lets you live in Italy and travel in Schengen under the usual Schengen rules for residence-permit holders. It is not an EU passport.

Not a sales desk: If the office starts invoicing or contracting in Italy, it can become a permanent establishment. That is a different legal and tax file. This product is the promotional office plus the representative's residence file.

The Process

Step 1: Document Preparation

We confirm the foreign company is real and operating, collect corporate documents (registration, charter, directors), and prepare the board resolution that opens the Italian office, sets the address, and appoints the representative.

Step 2: Register the Representative Office

The office is registered with the Italian Companies Register (Registro delle Imprese / Camera di Commercio) and obtains an Italian tax code. This is formation of a representative office, not incorporation of a trading company.

Step 3: Clearances and Visa File

The representative then files the national-visa / residence path that fits the appointment. Typical pieces are Chamber of Commerce attestations where required, Questura nulla osta, and a national visa at the Italian consulate of residence. The exact visa label (self-employment vs intra-company) depends on whether the person is an employee of the foreign company or an appointed representative. We do not force a statute cite that does not fit the file.

Step 4: Entry and Permesso di Soggiorno

After entry on the national visa, the representative applies for the permesso di soggiorno at the local immigration desk within the statutory window (commonly 8 working days of entry). Fingerprints and card issuance follow at Questura.

Requirements

  • Operating foreign company: Legally formed in its home country, with registration extract, charter, and named directors or shareholders.

  • Board resolution: Authorizes the Italian representative office, states the Italian address, and appoints the representative.

  • Italian address: A real premises or a compliant domiciliation. A P.O. box is not an office.

  • Appointed representative: Passport, apostilled birth record, and apostilled criminal record from the country of residence, as the consulate requires.

  • Proof of role: Employment contract with the foreign company and/or the appointment as representative. Consulates look for a genuine link, not a paper title.

  • Foreign company financials: Recent accounts or bank evidence showing the company can fund the office. There is no single published euro turnover number we will invent here.

  • No commercial activity in Italy: The office is limited to representation, research, and promotion. Selling or producing in Italy is out of scope.

Important Notes

  • Promotional office only. A representative office may not sell, invoice, or produce in Italy. Crossing that line can create a permanent establishment and a different visa problem.

  • The visa follows the role. If the office closes or the person is no longer the representative, the residence basis falls away.

  • Two legal tracks exist in practice: a self-employment / lavoro autonomo file tied to Chamber attestations, and an intra-company secondment file under the Immigration Code when the person is a genuine employee posted to the Italian office. Majority shareholders who are not employees can be refused on the secondment track. We pick the track that matches the facts.

  • No investment quota. This is not the Italian investor visa and not a decreto flussi work quota for ordinary employment.

  • Tax: The foreign company is generally not taxed in Italy on a pure representative office that does not conclude business. The individual becomes an Italian tax resident if they meet the ordinary residence tests (including spending more than 183 days in Italy). Confirm with a tax advisor.

  • Long-term residence (permesso UE per soggiornanti di lungo periodo) is a later, separate application after years of valid permits and the other statutory tests. Do not treat the first card as permanent residence.

  • Dependents are possible when the consular checklist allows family reunion or accompanying family on this visa type. We confirm that per nationality before we quote it.
