Employer Requirements

Qualifying relationship: The US and foreign entities must have a qualifying relationship as parent company, branch, subsidiary, or affiliate.

Doing business: Both the US entity and the foreign entity must be doing business (or will be, for new offices). This means regular, systematic, and continuous provision of goods or services, not merely maintaining an office or agent.

Employee Requirements

One year of employment: You must have worked for the qualifying foreign organization for one continuous year within the three years immediately preceding your US admission.

Executive or managerial capacity abroad: Your foreign employment must have been in an executive or managerial capacity.

Executive or managerial role in US: You must be coming to the US to work in an executive or managerial capacity.

Definitions

Executive capacity: Making decisions of wide latitude without much oversight. Directing the management of the organization or a major component.

Managerial capacity: Supervising and controlling professional employees, or managing an essential function at a high level. Managers of functions do not need direct reports but must manage at a senior level.

New Office Petitions

If establishing a new US office, you must also show: secured physical premises, one year of qualifying foreign employment, and that the US office will support an executive or managerial position within one year of approval.

Important Notes

L-1A vs L-1B: L-1A is for executives and managers. L-1B is for employees with specialized knowledge. Different criteria and maximum stay periods apply.
